I, the undersigned, understand that as faculty, visiting scientist, staff or student of New Mexico State University (NMSU), I may be working on a project sponsored by the federal government and may be working on future federally sponsored projects.

 

I further understand that NMSU, in order to obtain rights now belonging to the federal government has certain additional obligations for patentable intellectual property conceived under federal agreements, and fulfillment of these requirements will allow NMSU to take title to these patents.

 

In addition, I further understand that the conditions under which I am employed by NMSU necessitate that NMSU protect its interest in intellectual property generated by employees or personnel using its facilities, whereby the interests of the originators are also protected.

 

I therefore agree that I will furnish to the NMSU Intellectual Property Officer through my immediate supervisor the following information for each item of patentable intellectual property generated as a result of efforts at NMSU under a federally sponsored agreement:

 

1.                  a description of the patentable intellectual property in sufficient detail to be

understood

 

2.                  the sponsored agreement number under which the patentable intellectual

property was created

 

3.                  a notification of any impending acts (e.g., presenting a paper, publishing, or

disclosing the invention) which may destroy patentability.

 

The university, at its discretion, will handle the patentable intellectual property following its normal procedures.  My disclosure of the patentable intellectual property does not obligate the university in any way, but in the event the university elects to proceed with legal protection, I further agree that I will execute all documents necessary to assist in obtaining patent protection on the intellectual property.

 

This agreement is made in recognition of the university’s requirements under 37 CFR Part 401 (including the sharing of royalties) and in conformance with the university’s policies governing intellectual property as set forth in the NMSU Administrative Policies and Procedures Manual.

New Mexico State University recognizes that faculty, visiting scientists, staff and students may create commercially valuable intellectual property as a result of their involvement in their normal duties of teaching, scholarship, research, and services.

 

It is the policy of the university to foster the creation and dissemination of intellectual property by establishing a strong motivational influence for members of the faculty, visiting scientists, staff and students, to provide the advice and assistance of university administration to originators of intellectual property and to assure compliance with agreements between the university and sponsors of university programs.

 

The attached agreement must be signed in recognition of the university’s requirements under 37 CFR Part 401 (including the sharing of royalties) and in conformance with the university’s policies governing intellectual property as set forth in the New Mexico State University Administrative Policies and Procedures Manual.
